The Unstuck Box Enhanced Engagement Guarantee Policy

1. Overview

The Unstuck Box Enhanced Engagement Guarantee ("Guarantee") is an exclusive, invitation-only offer that provides eligible purchasers with a money-back guarantee if their team's measured engagement scores do not improve after 90 days of active product use.

Parties: In this agreement, "we," "us," and "our" refer to The Unstuck Box, an imprint of Flightpath Publishing Inc. "You" and "your" refer to the purchaser accepting this Guarantee.

2. Eligibility

2.1 Invitation Requirement

  • This Guarantee is available ONLY to purchasers who have received a direct invitation from The Unstuck Box
  • Participation requires acceptance of the invitation and agreement to these terms
  • This offer is not available to the general public

2.2 Team Definition

  • A "team" consists of a manager and their direct reports
  • Minimum team size: 5 people (including the manager)
  • ALL team members must have access to and use the covered products during the measurement period

2.3 Active Usage Requirement

  • Teams must actively use the covered products at least once per week throughout the 90-day measurement period
  • Usage can be interchangeable between any of the covered products (see Section 2.4)
  • Both managers and their direct reports must participate in using the products

2.4 Covered Products

This Guarantee applies ONLY to the following products:

  • The Unstuck Box One to Ones
  • The Unstuck Box Performance Improvement
  • The Unstuck Box Conflict Resolution
  • The Unstuck Box One to Ones Planner
  • The eDeck app

No other products are covered under this Guarantee.

3. Measurement Requirements

3.1 Baseline Measurement

  • Teams must complete an initial engagement survey BEFORE beginning use of The Unstuck Box products
  • ALL team members who will use the products must participate in the baseline survey

3.2 Follow-up Measurement

  • A follow-up survey must be completed after 90 days of product use
  • The SAME individuals who completed the baseline survey must complete the follow-up survey
  • 100% participation from the original survey group is required

3.3 Survey Platform

  • Surveys must be conducted using a mutually agreed upon, independent survey tool accessible to both parties
  • We recommend Google Forms, but alternative platforms may be used with mutual agreement
  • You are responsible for any costs associated with the survey platform
  • Survey results must be transparently available to both parties

3.4 Improvement Standard

  • ANY measurable improvement in engagement scores qualifies for meeting the Guarantee
  • There is no minimum improvement threshold

4. Timeline

4.1 Start Date

  • The 90-day measurement period must begin on a mutually agreed date
  • This date must be within 3 months of the purchase date
  • The baseline survey must be completed before this start date

5. Verification and Monitoring

5.1 Usage Verification

  • We reserve the right to request proof of regular usage patterns for physical products
  • For digital products and apps, we may monitor usage data to verify active participation
  • You agree to provide reasonable documentation of usage upon request

6. Organizational Stability Requirement

6.1 Disclosure Obligation

  • You must disclose if your organization is undergoing or anticipating significant disruption, including but not limited to:
    • Major restructuring
    • Significant layoffs
    • Merger or acquisition
    • Leadership changes at the executive level

6.2 Right to Withdraw

  • We reserve the right to withdraw from this Guarantee agreement if we determine that organizational instability would materially affect the validity of the measurement

7. Guarantee Limitations

7.1 Maximum Liability

  • Our maximum liability under this Guarantee is limited to the total amount you paid in the qualifying transaction for the covered products

7.2 Refund Scope

  • The Guarantee covers a refund of the amount paid for all covered products purchased in the qualifying transaction
  • No additional compensation, damages, or reimbursements will be provided
  • Refunds will be processed within 30 days of approved claim

7.3 Product Exclusions

  • This Guarantee does NOT apply to customized products or solutions
  • Only the standard products listed in Section 2.4 are covered

8. Claims Process

To claim under this Guarantee, you must:

  1. Provide completed baseline and 90-day survey results showing no improvement
  2. Demonstrate continuous weekly usage throughout the measurement period
  3. Verify that the same team members completed both surveys
  4. Submit your claim within 30 days of completing the 90-day survey
  5. Cooperate with any reasonable usage verification requests

9. Dispute Resolution

The specific dispute resolution process will be mutually agreed upon at the start of the Guarantee period and documented separately.

10. General Terms

  • This Guarantee is non-transferable
  • We reserve the right to modify or discontinue this program with 30 days' notice to active participants
  • All decisions regarding eligibility and claims are at our sole discretion
  • This Guarantee is void where prohibited by law

11. Acceptance

By accepting an invitation to participate in the Enhanced Engagement Guarantee program, you acknowledge that you have read, understood, and agree to be bound by these terms.
